Terms and Conditions
Introduction
Thank you for choosing Rental Safety Inspection Pty Ltd for your property’s safety and compliance needs. By enrolling your property in our services, you agree to be bound by these Terms.
These Terms and Conditions (“Terms”) and the accompanying schedule (“Service Terms”) apply to all services we provide, including smoke alarm, gas, and electrical safety and compliance checks, as well as any other services we may offer from time to time (collectively, the “Services”).
If there is any inconsistency between these Terms and the Service Terms, these Terms will prevail. We may update these Terms from time to time, including in relation to fees, cancellation, or the Services offered.
Please also review our Privacy Policy, which forms part of these Terms. By accepting these Terms, you consent to the collection, use, and disclosure of your personal information in accordance with that policy.
Definitions
- Agent: Your appointed property manager as at the Commencement Date.
- Australian Consumer Law: Schedule 2 of the Competition and Consumer Act 2010 (Cth).
- Commencement Date: The date on which a Service begins for an Enrolled Property, as confirmed in writing.
- Enrolled Property: A property enrolled in one or more Services.
- Excluded Property: A property that is not eligible for Services. This may include properties that are:
- Not a domestic residential dwelling.
- Of a type we do not ordinarily service, as notified by us.
- Not validly enrolled due to your or your Agent’s act/omission.
- Managed by a different agent during the term.
- Suspended or terminated under these Terms.
- Not a domestic residential dwelling.
- Property: Includes rental or owner-occupied properties (e.g., flat, apartment, residence, premises).
- Related Entities: As defined under the Corporations Act 2001 (Cth), including but not limited to Rental Safety Inspection Pty Ltd (ABN 50 688 246 504).
- You: The property owner of the Enrolled Property.
The Services
Your Enrolled Property will receive the Services during the Term, subject to timely payment of Fees.
Fees & Payment
- Fees: Depend on the Services your Enrolled Property is enrolled in and will be communicated at enrolment.
- Authorization: You authorise your Agent to pay us on your behalf.
- Payment: Fees must be paid within 14 days of the invoice without deduction or set-off.
- Subscription Payments: Processed via a secure third-party provider.
- Refunds: At our sole discretion, may be prorated, and exclude non-refundable payment processing fees.
Suspension & Termination
- Termination by You: You may terminate Services at any time with written notice. The Property will then become an Excluded Property.
- Suspension by Us: We may suspend Services immediately if:
- Fees remain unpaid past the due date.
- You or your Agent breach these Terms.
- We are not provided with required information or access.
- Our recommendations for compliance are not followed.
- Health/safety concerns prevent access.
- Fees remain unpaid past the due date.
- Termination after Suspension: If suspended, Services may be terminated by notice.
Following Suspension or Termination
- Any unpaid Fees become immediately due.
- We accept no responsibility for compliance obligations or Serviced Equipment from the Termination Date.
- You assume all risks at law relating to Serviced Equipment after termination.
- If your Agent terminates Services because they no longer manage the Property, you must indemnify your Agent for any Fees still payable to us.
Service Terms (Schedule)
1. Smoke Alarm Safety & Compliance Service
- Annual Service Fee: $89 + GST.
- Includes cleaning, testing, battery checks, compliance assessment, and replacement of faulty/expired alarms (excluding excess or FIP-linked alarms).
- Electrician attendance included at no extra cost if needed for replacement.
- 12-month guarantee (free call-outs/rectifications). Voids if Property becomes excluded.
- Relocation/replacement may cause cosmetic damage. Professional repairs (painting/plastering) are at your cost.
2. Gas Safety & Compliance Service
- Biennial Service Fee: $220 (inc. GST).
- Includes full gas compliance check, CO/spillage/pressure tests, and a digital report.
- 12-month guarantee for free call-outs and minor repairs (pilot lights, thermocouples). Voids if repairs declined or Property excluded.
3. Electrical Safety & Compliance Service
- Biennial Service Fee: $200 (inc. GST).
- Includes switchboard inspection, RCD/safety switch tests, appliance/fitting checks (where accessible), and a digital report.
- 12-month guarantee for call-outs and replacement of standard switches, safety switches, fuses, breakers (Excludes lighting and inaccessible items).
4. Defective Reports & Third-Party Repairs
If you arrange your own contractors to carry out repairs after we issue a compliance report:
- We cannot issue an updated or compliant report based on third-party work alone.
- A full reassessment must be carried out by our qualified team before a new report is issued. This reassessment incurs a flat fee of $150 + GST, payable in advance.
Warranty & Third-Party Engagement
If Rental Safety Inspections deems a gas appliance unsafe or leaking and the appliance is still under manufacturer’s or supplier’s warranty, the landlord or managing agent may engage a third-party contractor for warranty assessment or repairs. If that contractor subsequently deems the appliance safe and no fault is found, Rental Safety Inspections will not be liable for, nor reimburse, any costs associated with the third-party attendance, assessment, or repairs.
Subscription Payments & Refunds
- All subscription payments are processed securely through our third-party payment provider.
- If a refund is approved, any non-refundable processing fees charged by the provider will be deducted from the refund.
- Refunds are at our discretion, may be prorated for unused time, and exclude these processing fees.
- We encourage you to review the service scope and cancellation terms before subscribing.
RCD / Safety Switch Testing – Limitation of Liability
During routine compliance testing of Residual Current Devices (RCDs) / safety switches (as required under AS/NZS 3019), it is possible that a unit may fail under test conditions and not reset or operate correctly.
If an RCD / safety switch fails during testing and cannot be returned to service:
- This failure is deemed to be due to the condition of the device, not the testing process.
- Rental Safety Inspections Pty Ltd accepts no liability for such failures.
- Responsibility for replacement lies with the property owner/landlord.
- We will provide a quotation for replacement or repair as a separate service, carried out only upon approval and charged at standard rates.
Exception:
If the property is enrolled in the Rental Safety Inspections Subscription Model, this limitation does not apply. In such cases, replacement or repair of failed RCDs / safety switches will be included in accordance with the subscription terms.
Smoke Alarm Battery and Expiry Policy
In accordance with AS 3786 and relevant regulations, Rental Safety Inspections Pty Ltd does not replace batteries in smoke alarms that are expired or found to be non-operational due to the unit’s age or condition.
If a smoke alarm is determined to be expired or non-functional (e.g., past its manufacturer’s expiry date or failing to respond to tests), the entire alarm unit must be replaced. We will provide a quote for replacement as a separate service.
Exception:
If the property is enrolled in the Rental Safety Inspections Subscription Model, this limitation does not apply. In such cases, expired or non-operational smoke alarms will be replaced on-site as part of the subscription coverage, unless additional circumstances apply outside the normal scope of the subscription.
Acceptance of Terms
By subscribing to our services or requesting a compliance report, you confirm that you have read, understood, and accepted these Service Terms, including our refund, reassessment, and third-party repair policies.
Restrictions & Exclusions
We are responsible for:
- Performing Services with due care and skill.
- Ensuring Services are fit for purpose and delivered within a reasonable timeframe.
- Repairing damage caused by our negligence.
- Liability for death or personal injury caused by us.
We are not liable for:
- Indirect or consequential losses (profits, data, revenue, etc.).
- Delays outside our control (equipment failure, natural disasters, pandemics, strikes, government restrictions).
- Services in respect of Excluded Properties.
Your Liability
You are not liable to us for indirect or consequential losses caused by your breach of these Terms.
Governing Law & Assignment
These Terms are governed by the laws of the state/territory where your Property is located.
If part of these Terms is unenforceable, the remainder continues in effect.
You may assign
your rights where permitted. We may assign some or all of our rights/obligations under these Terms.
